City of Countryside Liquor Control Commissioner met March 6.

Public Hearing

Present: Mayor Sean McDermott

Attorney Erik Peck, on behalf of the City

Attorney Kevin Kearney, on behalf of the City

Attorney Robert L. Forgue, on behalf of Licensee

Mayor McDermott called the Public Hearing to order at 2:00 p.m. This hearing is held pursuant to the City Code of Countryside to consider charges filed against Smoke & Talk Tobacco Inc., for alleged violations of selling tobacco products to minors as set forth in the Notice of Charges and Hearing. This hearing has been called pursuant to a Notice served upon the Licensee in accordance with both the Statutes of the State of Illinois and Ordinance of the City of Countryside.

Attorney Kearney stated that the parties have come to an agreement in this matter.

Defendant will plead liable to the sale documented in the above-entitled matter. They will serve a one-week suspension of license from March 16 through March 22, 2020 and pay a fine of $1,000, payable within 30 days, to the City of Countryside. and the City will nolle pros citation numbers 39446 and 40456. Attorney Forgue agreed.

Mayor McDermott found that Smoke & Tobacco Inc., has violated provisions of the City Code as charged. He imposed the fine of $1,000 and suspended the dealer’s business license for Smoke & Talk for a period of seven days, March 16 through March 22, 2020.

If the licensee is found in violation another time, the license will be suspended for a significantly longer period of time.

Attorney Forgue agreed and asked for further guidance from Counsel and from the Police Chief to help the dealer’s staff in trying to determine a valid ID. Technology is so great today that’s it is difficult to detect fraudulent identification.

Mayor McDermott stated that the City revised the Ordinance recently so that prospective buyers that appear younger than age 27 must be carded. Attorney Forgue sought assistance from the Police Chief to further educate the licensee staff by supplying instruction booklets that assist in detecting fake IDs.
