Village of Western Springs General Government Committee met Sept. 3.

This public meeting was held using the Zoom on-line platform as authorized by the Open Meetings Act, the CDC directive (social distancing guidelines) and Illinois Governor Disaster Proclamation dated July 24, 2020 (Phase 4 Restore Illinois Plan), and Executive Order 2020-48 extending the Governor 's prior Executive Orders relating to the COVID-19 pandemic and his implementation of the "Restore Illinois" Plan (Community Revitalization Order - COVID-19 E.O. No. 45).

Chair Tyrrell moved to open the committee meeting, seconded by Member Chen. The motion passed on a roll call vote. Voting aye: Member Chen and Chair Tyrrell. The General

Government Committee meeting was called to order at 11 :49 a.m.

2. Approval of Minutes

Chair Tyrrell moved, seconded by Committee Member Chen, to approve the minutes of the meeting of August 6, 2020 as read. The motion passed on a roll call vote. Voting aye: Chair Tyrrell and Member Chen. Voting nay: None.

3. The Village Club Raffle License Request

Mr. Frank Schimmel participated in the meeting and said the Village Club is experiencing reduced revenues due to COVID-19 and recently put a new roof on the Club and are working on fixing the floors. An economic development loan in the amount of $53,000 was obtained to fund repairs and the raffle proceeds would be used to pay off or pay down that loan. The plan is for a "Queen of Hearts" type raffle with a drawing at the Village Club each week. Village Club Board members will manage the raffle and the drawing via a Zoom webinar format. Tickets sales will occur on-line and via traditional in-person sales by Club members.

Attorney Jurusik explained the need for a code amendment ordinance that updates the Village's raffle regulations to permit electronic raffles, State-wide sales of raffle tickets and third-party online raffle operations who may assist or conduct raffles and sell raffle tickets consistent with the recent legislative amendments to the Act. Currently, raffle tickets are only allowed to be sold within the Village boundaries. Additionally, the new Code language addresses the contracting of third-party raffle operators/vendors and requires information about the operator/vendor to be disclosed to the Village during the application process. In conjunction with this update, the current raffle application has also been revised to reflect the applicable Village Code amendments. The Application also clarifies that, while sales may occur on-line, they still must occur only within the State of Illinois (per the Act), so any vendor must be responsible for complying with that limitation.

These Code amendments are required because the provisions of Section 3-12-3 (Raffles) of the Western Springs Municipal Code strictly follow and incorporate the provisions of the Act. As a non-home rule community, the Village is limited to following the raffle regulations set forth in the Act. However, the Act expressly allows the governing body of any mimicipality to establish a licensing system with rules and ordinances that may be more restrictive than are provided for in the Act.

The Village can limit the type of raffle games that can be operated. Each application can be reviewed to determine if the requested raffle type is acceptable to the Village.

Chair Tyn-ell moved, seconded by Committee Member Chen, to recommend the Board approve the Code amendments discussed today and to issue a raffle license to the Village Club for their raffle. The motion passed on a roll call vote with Chair Tyrrell and Member Chen voting aye. Voting nay: None.

In the interest of expediting this matter, the Board will be asked to vote on both items on September 14, 2020.

4. Resolution Approvine the Content of and/or Release of Certain Closed Meeting Minutes of the Regular and Special Meetings of the Board of Trustees (2019 Full-Year and 2020 Half-Year Review)

Chair Tyrrell and Member Chen reviewed the draft closed meeting minutes and Attorney Jurusik's recommendation regarding whether to release or withhold the minutes. The approval of resolution will be considered in the September Board meeting cycle. Chair Tyrrell moved, seconded by Committee Member Chen, to recommend the Board approve this resolution on September 28, 2020. The motion passed on a roll call vote with Chair Tyrrell and Member Chen voting aye. Voting nay: None.

5. Other

None.

6. Schedule Next Committee Meeting

The Board's has meetings scheduled on September 14 and 28 as well as October 12 and 26. The General Government Committee set their next meeting on Thursday, October 8, at 11:45 a.m

With no further business to discuss. Chair Tyrrell moved, seconded by Member Chen, to adjourn the committee meeting at 12:42 p.m.

The motion passed on a roll call vote. Voting aye: Chair Tyrrell and Member Chen.
