City of Countryside City Council met June 10.

Here is the minutes provided by the council:

A. CALL TO ORDER – Pledge of Allegiance led by Mayor McDermott.

The meeting was called to order at 7:30 p.m. via electronic transmission – video conferencing.

B. ROLL CALL

City Clerk Kmet called the Roll of those physically present as follows:

Present: Mayor McDermott, Alderman Von Drasek, Alderman Musillami, Alderman Finn, City Clerk Kmet

Also Present: Police Chief Ford, City Administrator Paul, Attorney Peck, Asst. Administrator Peterson, Finance Director Schutter, City Engineer Fitzgerald

Electronically Present: Alderman Mikolyzk, Alderman Jasinski, Alderman Benson, Treasurer Stancik

C. OMNIBUS AGENDA

1. The Minutes of the Regular Meeting of May 13, 2020 were previously distributed to the members of the City Council. Mayor McDermott asked if there were any corrections to be made to said Minutes. There were none.

2. Approve Minutes of the Special City Council Meeting of May 27, 2020.

3. The Statement of Bills submitted for payment through June 10, 2020: $558,174.07.

I move to approve the minutes of the City Council Meeting of May 13, 2020 and the Special City Council Meeting of May 27, 2020, and to approve the Statement of Bills through June 10, 2020 in the amount of $558,174.07.

A motion was made by Alderman Musillami, seconded by Alderman Finn, that this matter be APPROVED as presented. The motion carried by the following vote:

D. COMMUNICATIONS FROM THE PUBLIC

a. Nadine Beals suggested that visuals of these meetings be sent to participants after the meeting to keep the public informed. Please ask speakers to speak into the microphones; the sound quality is not good.

E. MAYOR’S REPORT

1. Mayor McDermott thanked City Staff for all the great work they did maintaining City services through the three phases of the Coronavirus pandemic –Gail Paul, Sharon Peterson, Chief Ford and the entire staff did an exceptional job; thank you for your hard work. Also, thanks to the Police Department for putting in extra hours assisting the Village of LaGrange with peaceful protests on two separate occasions. Please pass the kudos on to the Police Officers.

2. The City received notice from State Senator Jackie Collins that Countryside will receive $2.5M from the Capital Bill recently approved in Springfield. The City will use the funds for Route 66 Improvements, additional lighting or building a pedestrian bridge across Joliet Road connecting the new bike path to the Forest Preserve. Other news – the City received word from the U.S. Green Building Council that the new Municipal Complex has received LEED Certified GOLD – which is the second highest certification possible – a real accomplishment for the City.

H. COMMITTEE AND COMMISSION REPORTS FOR DISCUSSION, CONSIDERATION AND, IF SO DETERMINED, ACTION UPON:

1. ECONOMIC DEVELOPMENT - NO REPORT

3. HUMAN RESOURCES COMMITTEE – NO REPORT

4. INFRASTRUCTURE COMMITTEE

a. Alderman Benson sought consideration to approve the Attached Water Rate Ordinance passing along the increased cost to Indian Head Park and LaGrange Highlands.

A motion was made by Alderman Mikolyzk, seconded by Alderman Von Drasek, that this matter be APPROVED as presented. The motion carried by the following vote:

Aye: 6 Alderman Von Drasek, Alderman Mikolyzk, Alderman Musillami, Alderman Jasinski, Alderman Finn, Alderman Benson

City Clerk Kmet declared that this will be known as ORDINANCE 20-14-O.

5. PLAN COMMISSION/ZONING BOARD OF APPEALS

a. City Attorney Peck sought Consideration of an Ordinance Approving the Preliminary and Final Plat of Resubdivision of 10525 – 74th Street. This recommendation is subject to review by the City Engineer -- that the requirement for sidewalks be temporarily waived until such time as either adjoining properties install sidewalks -- and that the address plat be submitted to the Building Department and to the Pleasantview Fire Protection

District. The PC/ZBA recommendation was to approve the Resubdivision. Alderman Von Drasek stated that area residents are very grateful that their concerns were addressed.

A motion was made by Alderman Von Drasek, seconded by Alderman Musillami, that this matter be APPROVED as presented. The motion carried by the following vote:

City Clerk Kmet declared that this will be known as ORDINANCE 20-15-O.

b. Consideration of an Ordinance Amending the Zoning Map (Rezoning) at 10525 – 74th Street. On 12-3-19 and 5-5-20 the PC/ZBA held a hearing on the Applicant’s request to rezone the subject property from R-7 to B-3, keeping the northern portion of the lot as R-7, but making the southern portion B-3. After hearing all testimony and evidence, the PC/ZBA found that all requirements for the rezoning were met, and it was their recommendation to rezone the property as above stated.

A motion was made by Alderman Finn, seconded by Alderman Mikolyzk, that this matter be APPROVED as presented. The motion carried by the following vote:

City Clerk Kmet declared that this will be known as ORDINANCE 20-16-O.

c. Consideration of an Ordinance Granting a Special Use Variation at 10525 – 74th Street - Fred Hoffmann. On 12-3-19 and 5-5-20 the PC/ZBA held a hearing on the Applicant’s request for a Special Use for the construction and operation of an automotive service station upon the portion of the property commonly known as 10525 74th Street. After hearing all testimony and evidence, the PC/ZBA found that all requirements for a Special Use had been met. There were no objections, either written or oral, at either hearing. Concerns were raised that have been addressed by the Applicant. The PC/ZBA approved the Special Use subject to the 12 conditions listed below:

1. All construction and operation of the use shall be in substantial conformity with the Planning and Zoning Memorandum dated May 1, 2020;

2. A 12-foot solid fence be installed along the entire north and west property line to screen residential properties;

3. If any lighting is proposed on site as part of the overall project, then a Photometric Plan shall be submitted with review/approval by the City Engineer and CDD;

4. If there is use of a dumpster on site, then a refuse and recycling enclosure shall be installed pursuant to City Code;

5. If any signage is proposed on the canopies or along the road, then a Sign Permit shall be submitted with review/approval of the CDD;

6. A Landscape Plan shall be submitted subject to review/approval by the CDD;

7. A Building Permit shall be submitted for all construction subject to review/approval by the CDD;

8. A copy of the Driveway Permits for accessing 75th Street shall be submitted to the CDD as part of the Building Permit submittal;

9. The Final Engineering Plans shall be subject to review/approval by the City Engineer;

10. There shall be no access to 74th Street from either parcel;

11. All construction and operation permitted by such Special Use Variation shall be subject to all applicable codes, ordinances and regulations of the City of Countryside;

12. That said use be established within one year from the effective date of any ordinance granting the same.

6. SPECIAL EVENTS COMMITTEE

a. Alderman Jasinski stated that due to the coronavirus pandemic, the City has cancelled the entire Concert Series for 2020. We look forward to a great celebration next summer.

7. SUSTAINABILITY COMMITTEE – no report

8. FLAGG CREEK ADVISORY BOARD

a. Alderman Von Drasek stated that on Wednesday, June 17, there will be a Golf course Board meeting here at City Hall.

I. LEGAL REPORT

1. Attorney Peck sought consideration of an Ordinance Adopting and Ratifying the City of Countryside Board of Fire and Police Commission Rules and Regulations. The Commission met to update their Rules and Regulations; they have made substantial changes. Regarding original testing for patrol officers, they added bilingual preference points, which are available to any candidate. They also changed the grading -- any written test must receive a grade of 70% or greater in order to advance to the oral examination. Lateral hires were also updated, giving the Chief of Police more latitude in recruiting lateral hires should that be necessary. Finally, a change to the promotional exam states that a combination of written and oral scores including a minimum of 70 Department evaluation points is required in order to be placed on the roster of eligible candidates. Those are the major changes. The Commission asks that the City adopt those Rules and Regulations using the City’s Home Rule powers.

J. CITY ADMINISTRATOR’S REPORT

1. City Administrator Paul sought consideration of Payment Request #29 in the amount of $22,923.00 under the Project Guaranteed Maximum Price (GMP) to Frederick Quinn Corporation (FQC).

A motion was made by Alderman Benson, seconded by Alderman Jasinski, that this matter be APPROVED as presented. The motion carried by the following vote:

2. Ms. Paul sought consideration to apply for Build Illinois Grant Projects. Governor Pritzker announced a $45B investment in roads, bridges, schools and economic development projects. A portion of those funds was allocated for Fast Track Grants that are shovel-ready. Because of the high demand, those Grants have been closed. The City will apply for the regular program – not the Fast Track. City Engineer and Staff have identified two projects they believe would be most qualified. The first is the Dansher Park Water Main Replacement; the second is applied for under the Economic Development portion – to create public parking lots near 55th St. and LaGrange Road. With IDOT completion of roadway improvements, including widening 55th Street and intersection additions of dedicated right-turn lanes, those changes will significantly impact parking availability to all local businesses. The City will identify how many public spaces may be generated and install public parking to be shared by all businesses.
