A federal judge ruled that a Chicago teacher attempting to recover "fair share" union fees doesn't have a claim, the Chicago Daily Law Bulletin reported.
U.S. District Judge Harry Leinenweber granted the defendant's motion for summary judgment in the case. Joseph Ocol filed the class-action in 2018 against the Chicago Teachers Union and others, the Bulletin reported.
Ocol was attempting to recover his "fair share" fees that were paid to the union prior to the fees being deemed unconstitutional, according to the news agency. Leinenweber found that Ocol's case did not have a conversion claim because the defendants were acting in good faith.
Leinenweber wrote in his decision that conduct that was lawful under a statute cannot be found wrong if a court later strikes down that particular statute.
Ocol made claims of both federal and state statutes, which Leinenweber rejected, according to the news agency.
