PROPOSED RESOLUTION

TO AUTHORIZE THE DISTRICT TO ENTER INTO LOCAL AGENCY AND ENGINEERING SERVICE AGREEMENTS FOR DESIGN OF THE SAND RIDGE BICYCLE TRAIL

WHEREAS, the Forest Preserve District of Cook County (the “District”) has sought and been awarded funds from the Illinois Transportation Enhancement Program (“ITEP Grant”), a federally-funded program administered by the Illinois Department of Transportation (“IDOT”), to facilitate the construction of 1.3 miles of the Sand Ridge Bicycle Trail (the “Project”); and

WHEREAS, Phase II Engineering services for the Project are projected to be $50,000.00; and

WHEREAS, the District anticipates the use of ITEP Grant funds to cover 80% ($40,000.00) of the costs of Phase II Engineering Services to be provided in connection with the Project and the District intends to be responsible for 20% of the cost of Phase II Engineering or $10,000.00 in connection with the Project; and

WHEREAS, in order to meet deadlines for use of the funds provided via the ITEP Grant, it was advisable that a consulting engineering firm be employed to perform Phase II engineering; and

WHEREAS, in 2013, the District issued an RFQ for Phase I, II, and III engineering services and subsequently selected Christopher B. Burke Engineering, Ltd., Rosemont, Illinois to serve as Phase I Engineer;

WHEREAS, the District has selected Christopher B. Burke Engineering, Ltd. to perform Phase II

engineering services;

NOW, THEREFORE BE IT RESOLVED that the Board of Commissioners of the District hereby authorizes the District, through its President, to enter into a local agency agreement (the “Local Agency Agreement”), with the Illinois Department of Transportation (“IDOT”) to pay Phase II Engineering Service costs associated with the Project, subject to reimbursement of 80% by IDOT.

BE IT FURTHER RESOLVED that Christopher B. Burke Engineering, Ltd. be employed to perform Phase II Engineering services in connection with the Project, and that the President of such Board of Commissioners is hereby directed to execute, on behalf of the District, an agreement by and between the District and Christopher B. Burke Engineering, Ltd., for Phase II Engineering services (the “Preliminary Engineering Services Agreement for Federal Participation”).

BE IT FURTHER RESOLVED that, the Board of Commissioners of the District hereby confirms that sufficient funds are available in the District’s Professional Services accounts, and have been designated, to pay the total cost of Phase II Engineering services in the amount not to exceed $50,000.00 of which IDOT will reimburse 80% or $40,000.00 and the District ultimately shall be responsible for 20% of the Phase II Engineering costs or a maximum of $10,000.00.

BE IT FURTHER RESOLVED that copies of the Local Agency Agreement and the Preliminary Engineering Services Agreement for Federal Participation, when executed in their respective final form, shall be submitted to the IDOT for approval and final processing.end

PROPOSED RESOLUTION

RECOGNIZING THE DEDICATION OF HARMS FLATWOODS AS AN ILLINOIS NATURE PRESERVE BY THE ILLINOIS NATURE PRESERVES COMMISSION

WHEREAS, on January 24th, 2017, at the 225th meeting of the Illinois Nature Preserves Commission Harms Flatwoods was approved for dedication as an Illinois Nature Preserve (“INP”); and

WHEREAS, dedication of a site as a Nature Preserve provides the highest level of protection for land in Illinois, and is granted only to natural areas of exceptional ecological quality; and

WHEREAS, Harms Flatwoods Nature Preserve, a 102-acre preserve located in the Village of Skokie in northeast Cook County, consists of high quality northern flatwoods and mesic upland forest and supports a diverse community of native plants and wildlife, including 2 species listed as threatened or endangered in Illinois; and

WHEREAS, Harms Flatwoods Nature Preserve exhibits an excellent climax canopy community made up mostly of white oak, swamp white oak, bur oak, and red oak; and

WHEREAS, formal ecological management of the site has been ongoing since the late 1970s, and was conducted primarily by volunteer stewards under the guidance of scientists and Forest Preserve staff; and

WHEREAS, Harms Flatwoods Nature Preserve has benefitted from extensive volunteer participation by the North Branch Restoration Project, whose countless hours of service and dedication have helped make the site what it is today; and

WHEREAS, dedication of Harms Flatwoods as an Illinois Nature Preserve advances the goal set forward in the Next Century Conservation Plan to dedicate 20,000 acres as INP protected land by 2025, and is consistent with the recommendations of the Natural and Cultural Resources Master Plan;

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of the Forest Preserves of Cook County does hereby acknowledge this momentous dedication and the Forest Preserves' steadfast commitment to protect and restore our region's significant natural resources; and

BE IT FURTHER RESOLVED, that a suitable copy of this resolution be presented to the North Branch Restoration Project as a token of appreciation for their service to the Forest Preserves and the residents of Cook County.

PROPOSED RESOLUTION

TO APPROVE A COLLECTIVE BARGAINING AGREEMENT, SALARY SCHEDULE AND WAGE ADJUSTMENTS

WHEREAS, the Illinois Public Employee Labor Relations Act (5 ILCS 315/1 et seq.) has established regulations regarding collective bargaining with a union; and

WHEREAS, the Forest Preserve District of Cook County (the “Preserves”) recently received an interest arbitration award, pursuant to Section 14 of the Illinois Public Labor Relations Act, 5 ILCS 315/14, with respect to the wages for the police sergeants of the Preserves Police Department, all of whom are members of the Illinois Fraternal Order of Police Labor Council (Sergeants) collective bargaining unit; and

WHEREAS, the aforementioned interest arbitration award incorporated all tentative agreements between the Preserves and the Illinois Fraternal Order of Police Labor Council (Sergeants) which include, but are not limited to, healthcare revisions and other terms and conditions of employment, for the period of January 1, 2013 through December 31, 2017; and

WHEREAS, the terms and conditions of the aforementioned interest arbitration award are incorporated into a proposed Collective Bargaining Agreement between the Preserves and the Illinois Fraternal Order

of Police Labor Council (Sergeants) for the period of January 1, 2013 through December 31, 2017 (the “Sergeants Agreement”); and

WHEREAS, the general increases and wage adjustments the aforesaid award provides for are reflected in the Salary Schedule and are included in the Sergeants Agreement; and

WHEREAS, the current health care plan, which was negotiated between the Preserves and the Illinois Fraternal Order of Police Labor Council (Sergeants), is reflected in the Sergeants Agreement; and

NOW, THEREFORE, BE IT RESOLVED that the President and the Board of Commissioners of the Preserves do hereby approve the proposed Sergeants Agreement including, but not limited to the Salary Schedule and wage adjustments, as well as retroactive wage payments and salary increases for the period of January 1, 2013 through December 31, 2017 for covered employees who were duly appointed and in active payroll status with the Preserves on the date of passage and approval of this Resolution as follows:

(a) Effective the first full pay period on or after July 1, 2013 the pay rates for all classifications shall be

increased 1.00%

(b) Effective the first full pay period on or after July 1, 2014 the pay rates for all classifications shall be

increased 1.50%

BE IT FURTHER RESOLVED that the President and the Board of Commissioners of the Preserves do hereby approve the healthcare plan for Preserves employees who are members of the Illinois Fraternal Order of Police Labor Council (Sergeants) as described below and as reflected in the Sergeants Agreement.

BE IT FURTHER RESOLVED that the Preserves’ Director of Human Resources, Chief Financial Officer, and Comptroller are hereby authorized to implement the Salary Schedule, wage adjustments and healthcare provisions as negotiated and otherwise outlined in the Cook County Benefit Overview chart. BE IT FURTHER RESOLVED, that the Preserves’ Comptroller is hereby directed to make all payments consistent with this resolution. Adopted this 9th day of March, 2017.

Summary: On 6/24/2013, the District issued a Request for Qualifications for Phase I, II and III Engineering Services for the Sand Ridge Bicycle Trail. An agreement for Phase I Engineering was executed between Christopher B. Burke Engineering, Ltd. (“CCBEL”) and the Forest Preserve District of Cook County (the “District”) and all Phase I Engineering is now complete. The next project step is Phase II Engineering, which includes the preparation of plans and specifications for approximately 1.3 miles of bicycle trail from Sand Ridge Nature Center to Green Lake Aquatic Center funded with ITEP funding administered by the Illinois Department of Transportation. CBBEL was selected to complete Phase II Engineering Services based on its qualifications and familiarity with the project based on completion of Phase I work. The using department provided a sole source justification for this procurement.

The professional fees for Phase II Engineering services shall not exceed $50,000.00. Of the total fees, ITEP will fund 80% ($40,000.00), and the District is responsible for the remaining 20% ($10,000.00).

At each phase of the project, IDOT requires that the District enter into Local Agency and Engineering Service Agreements for Federal Participation to reaffirm the District’s funding commitment for 20% of the total project cost.end

PROPOSED INTERGOVERNMENTAL AGREEMENT

Request: Requesting authority to enter into an IGA with the Village of Skokie, Illinois for construction of (1) an approximately ten (10) foot wide, two thousand three hundred (2,300) foot asphalt trail and two hundred and fifty (250) foot stone spur between Harms Road and Woods Drive (“Stage I”), and (2) an approximately ten (10) foot wide, two hundred and fifty (250) foot asphalt trail connecting the Forest Preserve trails on the west side of Harms Road (“Stage II”). Stage I and Stage II are collectively the “Trail Connection”.

Goods or Services: The Forest Preserve District of Cook County (the “Preserves”) operates and maintains the North Branch Bicycle Trail in Northern Cook County. The Trail Connection is part of Skokie’s Bikeway System Plan to provide bicycle/pedestrian accommodations for residents, businesses, shopping malls, schools and transit connections along Old Orchard Road from Gross Point Road to the North Branch Trail. This agreement covers the approximately two thousand eight hundred (2,800) linear feet of trails that will be built on Forest Preserve property on the south side of Old Orchard Road.

Summary: Skokie has requested an Intergovernmental Agreement to construct the proposed Trail Connection. Skokie has obtained Transportation Alternatives Program funding for the construction of Stage 1 of Trail Connection. Skokie will be responsible for all design, permitting and construction costs associated with the Trail Connection, subject to review of final plans and specifications by the Preserves. All requirements regarding insurance and bonds must be met. It is anticipated that approximately one

hundred and ten (110) trees will be removed for this project. For each tree that is removed, Skokie will plant replacement trees or pay the replacement cost of planting the trees. The Preserves anticipates that the Trail Connection will be completed within approximately five (5) years. Skokie will be responsible for long-term maintenance of the Trail Connection upon completion, including annual inspections and snow removal. The Preserves, however, will retain responsibility for trimming and removing trees. The Intergovernmental Agreement is subject to final review and approval by the Preserves’ Legal Department.

The IDNR authorized extension of the IGA for a longer period ending on 6/30/2017. The IGA, however, was suspended by the IDNR effective 6/30/2015. An amendment to extend the IGA to 6/30/2020 is now being recommended by IDNR staff in order to have an agreement in place in case funding is restored, and to have a consistent end date.

Summary: Requesting authority, pursuant to Section 9 of the Cook County Forest Preserve District Act (70 ILCS810/9), to register Bobolink Meadow as an Illinois Land and Water Reserve ("ILWR") with the Illinois Nature Preserve Commission (“INPC”).

This dedication contributes to one of the key goals set forward in the Next Century Conservation Plan to dedicate and register twenty thousand (20,000) acres with the INPC by 2025. Dedication of a site as an ILWR provides a high level of protection for land in Illinois, and is granted only to natural areas of important ecological quality.

The proposed Bobolink Meadow ILWR is an approximately nine hundred and eighteen (918) acre portion of the preserves located in Tinley Park in south central Cook County. The site currently supports four hundred and sixty eight (468) plant species and one hundred and forty two (142) bird species, five (5) of which are threatened or endangered in Illinois. The site also provides critical breeding habitat for declining grassland birds, including the second largest population of Bobolinks (Dolichonyx oryzivorus) in the state of Illinois.

The Forest Preserves of Cook County (“FPCC”) currently has twenty three (23) dedicated Nature Preserves and three (3) Land and Water Reserves. The addition of Bobolink Meadow ILWR would bring the FPCC's total INPC protected lands to approximately 8,800 acres.

It is respectfully requested that authority be granted to the FPCC to submit Bobolink Meadow to the Illinois Nature Preserve Commission for review and formal dedication as an Illinois Land and Water Reserve.
