Elmwood Park Village Board passed an ordinance to regulate fire pits

At a recent meeting, the Elmwood Park Village Board considered an ordinance to empower the village to regulate the use of fire pits.

Below are the minutes from this meeting, as provided by the board.

TRUSTEES VILLAGE OF ELMWOOD PARK

June 20, 2016 7:00pm

The 2,196" meeting of the President and Board of Trustees was called to order by President Angelo “Skip” Saviano at 7:00pm. The Pledge of Allegiance was recited.

On roll call the following members were present: Anthony DelSanto, Jonathan Zivojnovic, Angela Stranges, Angelo Lollino, Alan Kaminski, Jeff Sargent and President Saviano, -

PUBLIC COMMENTS

Mr. Garlan Armstrong-2336 72" Ct-Fullerton/Harlem Potholes.

COMMITTEE REPORTS

The Village Clerk gave an update on the Rain Barrel program. She read an email from the MWRD which informed all rain barrel program partners that the free program will be discontinued December 31, 2016 and will be replaced by the former program in which residents can purchase rain barrels at cost from the MWRD. Trustee DelSanto reported on the “Relay for Life” event at the high school which raised over $16,000.00 for cancer research. Trustee Zivojnovic reported on the Plan Zoning recommendation for a map amendment and special use for the new parking lot at 1615 75" Ave. He also thanked all the village departments for their hard work on the Circle Car Show this past weekend. The Grand Corridor Chamber of Commerce “Split the Pot” raffle raised over $600 for the Elmwood Park Youth Commission. Trustee Sargent reported on the free pool pary sponsored by the Youth Commission that will be held on June 22" for 5" to 8" graders. Trustee Lollino reported on the Elmwood Park Market and concert in the park. This weeks concert will be held in the circle for the first time with the band “In Session”. He urged all to attend.

ATTORNEYS REPORT

Mr. Durkin reported on the Prevailing Wage ordinance on the consent agenda this evening. This is an annual requirement for the village to adopt and the required wage to be paid for any public works project. He reported that the Department of Labors latest wage schedule is dated July 2015. It has not been updated since them. He also requested

that item (e) and (f) on the consent agenda be removed from the consent agenda and placed under new business. He stated that Trustee Lollino would like to exercise his right to abstain from voting on that item even though, in his opinion, Trustee Lollino does not have a conflict of interest since he is a business owner in that area.

MANAGERS REPORT

Mr. Volpe reported on the map amendment and rezoning of the property at 1615 75th Ave, the construction of a public parking lot, holiday decorations and a new fire pit ordinance on the agenda this evening. A copy of his full report is attached hereto.

PRESIDENTS REPORT

President Saviano commended the various village departements on their hard work to make the Circle Car Show a success and encouraged everyone to attend our 4" of July Festivities at both the parade and fireworks display.

A motion was made by Trustee Kaminski and seconded by Trustee Sargent to remove items (e) and (f) from the consent agenda and move to new business. Motion carried.

d) An Ordinance Providing for the Declaration of the General Prevailing Rate of Hourly

Wages for the Year 2016 To Be Paid to Laborers, Mechanics and Other Workers Performing Construction of Public Works Within the Village of Elmwood Park, Cook

County, Illinois.

g) An Ordinance Amending Chapter 19, Entitled “Fire Prevention” of the Elmwood Park

Village Code to Provide for the Regulation of Fire Pits in the Village of Elmwood Park.

h) An Ordinance Accepting a Proposal from Artistic Holiday Designs, in the Amount of $14,425.44, for Holiday Decorations to be Displayed in the Village of Elmwood Park.

A motion was made by Trustee Lollino and seconded by Trustee Zivojnovic to approve the items on the consent agenda,

On roll call, the following voted “Aye”: Anthony DelSanto, Angela Stranges, Jonathan Zivojnovic, Angelo Lollino, Alan Kaminski, Jeff Sargent, and President Saviano. “Nay”: None. Motion Carried.

COMMUNICATIONS

A motion was made by Trustee Zivojnovic and seconded by Trustee DelSanto to accept the recommendation from the Carmen Forte, Jr., secretary of the Plan 4??? Commission, approving the map amendment and special use for 1615 N. 75' Motion carried.

The clerk read a “Thank You” note from the Mazzone Family thanking the President and Board of Trustees for the lovely flowers that were sent in sympathy for their mothers (Pearl Mazzone) passing. No action required.

NEW BUSINESS

The clerk read the items in new business:

e) An Ordinance to Approve a Map Amendment Rezoning the Village-Owned Property Located at 1615.75"Avenue to B-2 General Business District and Granting a Special Use Permit for the Construction of A Public Parking Lot at Said Location.

A motion was made by Trustee Stranges and seconded by Trustee DelSanto to approve item (e) in New Business. Trustee Lollino asked to abstain from the vote. A motion was made by Trustee Kaminski and seconded by Trustee Sargent to recuse Trustee Lollino from the vote. Motion carried. On the roll call the following voted “Aye”: Anthony DelSanto, Jonathan Zivojnovic, Angela Stranges, Jeff Sargent, Alan Kaminski and President Saviano. “Nays”: None. “Abstain”: Angelo Lollino. Motion carried.

f) An Ordinance to Approve and Authorize the Execution of a Standard Form At-Risk

Constructiion Management Contract for Designer-Led Design-Build Project by and

Between Burke, LLC and the Village of Elmwood Park for Demolition and Construction of a Public Parking Lot to be Located at 1615 N. 75th Avenue.

A motion was made by Trustee Kaminski and seconded by Trustee Stranges to approve item (f) in New Business. Trustee Lollino asked to abstain from the vote. A motion was made by Trustee Kaminski and seconded by Trustee Sargent to recuse Trustee Lollino from the vote. Motion carried.

On the roll call the following voted “Aye”: Anthony DelSanto, Jonathan Zivojnovic, Angela Stranges, Jeff Sargent, Alan Kaminski and President Saviano. “Nays”: None. “Abstain”: Angelo Lollino. Motion carried.

ADJOURNMENT

With no other business to be brought before the board, a motion was made by Trustee Zivojnovic and seconded by Trustee DelSanto to adjourn the meeting, Motion carried. Meeting adjourned at 7:15 pm.

Re; Manager's Report

1615 N. 75"Avenue

The Board will be asked to approve a map amendment re-zoning 1615 N. 75" Avenue to B-2 (General Business District) and granting a special use for the construction of a public parking lot. The Board will also be asked to approve a design-build project agreement with Burke, LLC to demolish the property currently located there and build a surface parking lot adding 12 new off-street parking spaces. The guaranteed maximum price is $130,328.80 including all demolition, concrete, asphalt, electrical and landscape work. We expect the work to be complete this

construction Season.

Holiday Decorations The Board will be asked to approve an agreement with Artistic Holiday Designs to provide 20 holiday pole

decorations. The total cost is $14,425,44. These decorations are consistent with those that we purchased in 2015. They will be installed along Grand Avenue.

Regulation of Fire Pits The Board will be asked to approve an ordinance to provide for the regulation of fire pits in the Village. Among other

things, the ordinance regulates the location and use of fire pits including the hours during which they can be used, The ordinance requires that the smoke generated by any fire pit cannot be a nuisance to any adjacent property. Any person who violates this ordinance shall be subject to a fine of up to $750 for each offense.
