C. RES 20-123 A Resolution Approving a Purchase of Self-Contained Breathing Apparatuses and Associated Equipment from Air One Equipment Inc. through the Houston Galveston Area Council Cooperative Purchasing Program in an Amount Not to Exceed $209,800.00 and Waiving the Village's Bid Process

Overview; This item was originally scheduled for the March 16, 2020 meeting of the Village Board which was cancelled following the adoption of Resolution 20-120 by the Village Board of Trustees “Declaring an Emergency Affecting the Public Health” on March 13, 2020. The Fire Department received an Assistance to Firefighter Grant (AFG) EMW-2018-FO-03732 (AFG) in the amount of $268,160.00 for the purchase of self-contained breathing apparatuses along with associated equipment and (2) PowerLoad Systems and Cots. The Village allocated the required 10% match ($26,816.00) for this grant in the 2020 capital equipment budget. This request relates to only a portion of the total AFG for the self-contained breathing apparatuses and associated equipment. The Powerload Systems and Cots were purchased in the 4th quarter of 2019.

D. RES 20-124 A Resolution Extending the Declaration Emergency Affecting Public Health through May 5, 2020 Due to the Outbreak of the COVID-19 Disease in the State of Illinois as Previously Declared by Resolution 20-120

Overview: The Village Board is being asked to extend the declaration of emergency affecting the public health through May 5, 2020 due to the outbreak of the COVID-19 disease in the State of Illinois as previously declared by Resolution

20-120. This is a necessary procedural step under state law and the Village Code to respond to rapidly changing challenges of the novel coronavirus disease, COVID-19.

E. RES 20-125 A Resolution Approving a Purchase Price Agreement with Core & Main LP for Materials for Repair of Water Mains, Fire Hydrants, Water Services and Sewer Services in an Amount not to Exceed $50,000.00 in Fiscal Year 2020 and Authorizing its Execution

Overview: This item was originally scheduled for the March 16, 2020 meeting of the Village Board which was cancelled following Resolution 20-120 of the Village Board of Trustees Declaring an Emergency Affecting the Public Health on March 13, 2020. The Water and Sewer Division of the Public Works Department is responsible for maintaining the water distribution and sewer collection systems in the Village. The department annually seeks competitive bids for water main parts and materials and sewer pipe parts and materials

F. RES 20-126 A Resolution Authorizing the Use of Motor Fuel Tax Funds in the Amount of $1,140,584.04 for Maintenance of Streets in the Village of Oak Park for the 2020 Fiscal Year

Overview: This item was originally scheduled for the March 16, 2020 meeting of the Village Board which was cancelled following Resolution 20-120 of the Village Board of Trustees Declaring an Emergency Affecting the Public Health on March 13, 2020.

The Village Engineers affirm the need to continue to proceed with certain activities related to the maintenance of streets at this time. The Village receives a monthly distribution of Motor Fuel Tax (MFT) funds from the Illinois Department of Transportation (IDOT). The Illinois Highway Code requires that each municipality receiving MFT funds use those funds for the limited purposes described in the Highway Code. This item is for those approved uses related to the costs of labor and materials for construction and maintenance of the public right of way. The Village is required to adopt a Resolution which obligates its share of MFT funds to one or more of the approved purposes set forth in the Highway Code.

G. ORD 20-032 An Ordinance Amending Section 15-3-18(F) of the Oak Park Village Code Regarding Parking Rates for the Village’s Avenue Garage

Overview: This item was originally scheduled for the March 16, 2020 meeting of the Village Board which was cancelled following adoption of Resolution 20-120 of the Village Board of Trustees Declaring an Emergency Affecting the Public Health on March 13, 2020.

Due to Lake Street construction project which is ongoing during the Emergency Affective Public Health, staff recommends it is necessary to proceed with this Village Board action so that the Village extend the free parking times at the Avenue garage from 1 hour to 1.5 hours consistent with the Village’s parking structures in the downtown parking garage.

H. ORD 20-023 An Ordinance Amending the Fiscal Year 2020 Annual Budget

Overview: An ordinance is hereby presented to appropriate funds for FY20 to approve the carryforward amendments from unspent 2019 appropriations in an amount equal to $5,800,744. In accordance with Village Resolution 20-120 (“A Resolution Declaring an Emergency Affecting the Public Health Due to the Outbreak of COVID-19 Disease in the State of Illinois”) and in accordance with Section 6 of Governor J.B. Pritzker’s’ Executive Order 2020-07, the requested carryforwards are deemed necessary and related to existing work or work completed for which the Village must fund, including Lake Street related carryforward, work funded from the Madison TIF and initiated prior to the expiration of the TIF, and previously completed Federal/State work for which we are awaiting billing from the State of Illinois.

The carryforward requests are for unspent expenses budgeted in the prior year and not re-appropriated in FY20 and typically related to timing issues in the receipt of vendor invoices. Reclassification amendments merely move budgeted amounts between or among accounts and no new money is being requested. Finally, new money requests do affect current year reserves and are true budget amendments in the sense that more will be expended than originally adopted in the FY20 budget.

I. ORD 20-031 An Ordinance Temporarily Waiving and Suspending a Portion of the Fees Charged by the Village for Parking Permits to Provide Emergency Assistance Due to the Outbreak of COVID-19 Disease

Overview: Due to the Covid-19 outbreak, staff is recommending that the Village decrease by 50 percent the quarterly permit fees for parking permits with start dates of April 1st and May 1st.

J. ORD 20-033 An Ordinance Temporarily Waiving and Suspending the Late Payment Penalty for Delinquent Water Charges to Provide Emergency Assistance Due to the Outbreak of COVID-19 Disease

Overview: Due to the COVID-19 disease outbreak, staff is recommending that the Village waive and suspend the 10% late payment penalty on water charges set forth in Village Code Section 26-2-3 for water/sewer bills due on or before December 31, 2020.

Please be aware that pursuant to Code Section 26-2-3, the late payment penalty is only applied on the portion of the water/sewer bill that pertains to water supplied (usage) charges. The sewer and refuse fee portion of the bill has always been excluded from the late payment penalty.
