Cicero Township Board of Trustees met June 13.

Here is the minutes as provided by the board:

The Board of Trustees of the Town of Cicero met Tuesday, June 13, 2017 at 10:00 A.M., in the Town Hall Council Chambers, Town of Cicero.


On roll call there were present: 

President: Dominick 

Clerk:        Punzo-Arias 

Trustees: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

Thereupon, President Dominick declared a quorum present and the meeting duly convened and requested that all present in attendance stand and join in the Pledge of Allegiance to the Flag.

On motion of Trustee Raleigh seconded by Trustee Garcia, the minutes of the Regular Meeting held Tuesday, May 23, 2017 at 10:00 o'clock A.M., were approved, the reading being dispensed with, each member having received a copy.

Presentation

The Resolution congratulating Patricia Filomeno for being the recipient of the Nazareth Academy "Educator of the Year" was accepted and placed on file.

Approval of Bills

On motion of Trustee Virruso seconded by Trustee Raleigh, the list of bills itemized in Warrant #11, dated June 12, 2017, in the total amount of $3,437,230.72, the list of manual checks dated May 18 thru June 7, in the total amount of $10,890.00, and the list of online payments dated May 18 thru June 8, in the total amount of $0.00, were accepted, placed on file and approved for payment; action taken by the following vote: Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso. Nays: None.

Block Party Permit

On motion of Trustee Garcia seconded by Trustee Raleigh, permission was granted the residents in the 2300 block of 61st Avenue to conduct a block party on July 15, contingent upon compliance of all town ordinances; action taken by the following vote: Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso. Nays: None.

Permits

On motion of Trustee Raleigh seconded by Trustee Banks, permission was granted City View Multicare Center to hold an Outdoor Picnic Event on Friday, June 30th, 2017 from 11:00 AM to 4:00 PM. Permission was also granted to block off the side street on 58th Court from Cermak just to the alley (behind the facility).

On motion of Trustee Raleigh seconded by Trustee Porod, permission was granted Combat-Do to solicit funds on Friday, June 30th through Sunday, July 2nd from 9:00 AM to 6:00 PM at various intersections (Cermak Rd. and Austin Blud & Cermak Rd. and Laramie Ave) throughout the Town.

On motion of Trustee Banks seconded by Trustee Virruso, permission was granted Good Shepherd Church of God to host (3) car washes drummage sales on June 17th, July 8th & July 15th, from 9:00 AM to 3:00 PM in the church parking lot.

On motion of Trustee Raleigh seconded by Trustee Porod, permission was granted Mary, Queen of Heaven to conduct their Annual Parish Summer Festival, which includes the blocking of streets surrounding the church (53rd Avenue between 24th Place and 25th Street and all of 24th Place between 53rd Avenue & 54th Court):

On motion of Trustee Virruso seconded by Trustee Garcia, permission was granted St. Anthony of Padua Parish to have a petting zoo on Town owned property located at 1500 South 49th Avenue for their Annual Parish Festival on Saturday, June 17th from 4:00 PM to 8:00 PM & Sunday, June 18th from 1:00 PM to 5:00 PM, approval contingent upon a certificate of insurance naming the Town of Cicero as one of the insured be submitted.

On motion of Trustee Virruso seconded by Trustee Raleigh, the Collector's Office Report ($2,613,234.54) and the Revenue Summary Report ($1,463,583.08) for the month of May/17, submitted by Fran Reitz, Collector, was accepted and placed on file; action taken by the following vote:

Ordinances

On motion of Trustee Raleigh seconded by Trustee Porod, the Ordinance adopting Chapter 2, entitled "Administration", Section 2-112, entitled "Minimum Hourly Wages" of the Code of Ordinances of the Town of Cicero, Illinois regarding conflicts with a certain home rule county ordinance for the Town, was accepted, placed on file and approved for passage by the following vote: 

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso. 

Nays: None.

(Purpose of Ordinance)

(The purpose of this ordinance is to define the minimum wage regulations that apply to employers located in the Town and to authorize the President and other Tour Officials to take all action necessary to carry out the intent of this Ordinance.)

Section 2-112: Minimum Hourly Wages.

a. Employers located within the Town shall comply with all applicable federal and/or State laws and regulations as such laws and regulations may exist from time to time with regard to the payment of minimum hourly wages. Employee eligibility for minimum hourly wages shall also be in compliance with all applicable federal and/or State laws and regulations as such laws and regulations may exist from time to time.

b. No additional obligations with regard to minimum hourly wages, including, without limitation, any additional obligations by ordinance adopted by the County of Cook Board of Commissioners, shall apply to employers located within the Town, except those required by federal and/or State laws and regulations as such laws and regulations may exist from time to time.

c. For the purposes of this Section, the term "employee" means an individual permitted to work by an employer regardless of the number of persons the employer employs, and the term "employer" means any person employing one or more employees, or seeking to employ one or more employees, if the person has its principal place of business within the Town or does business within the Town.

d. For the purposes of this Section, the term "employer" does not mean:

1. the government of the United States or a corporation wholly owned by the government of the United States:

2. an Indian tribe or a Corporation wholly owned by an Indian tribe;

3. the government of the State or any agency or department thereof, or

4. the government of any municipality.

On motion of Trustee Virruso seconded by Trustee Banks, the Ordinance amending Chapter 94, entitled "Traffic", Section 94-527 and 94-542 of the Code of Ordinances of the Town of Cicero, Illinois regarding bicycles for the Town, was accepted, placed on file and approved for passage by the following vote:

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

Nays: None.

(Purpose of Ordinance)

On motion of Trustee Reitz seconded by Trustee Raleigh, the Ordinance amending Chapter 106, entitled "Vehicles", Section 106-39, entitled "Classification of Fees; Expiration" of the Code of Ordinances of the Town of Cicero, Illinois regarding parking license fees for the Town, was accepted, placed on file and approved for passage by the following vote:

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

Nays: None.

(Purpose of Ordinance)

(The purpose of this ordinance is to update the existing regulations to require residents seeking certain classes of reduced license fees to show proof of identification and other supporting documentation and to authorize the President and other Town Officials to take all action necessary to carry out the intent of this Ordinance.)

Section 106-39: Classification of Fees; Expiration.

(a) For vehicles classified by the State of Illinois or having the following vehicle weights, the license fee shall be as follows:

(l) Passenger automobiles:

a. The first four automobiles registered to a single household, each. $50.00

b. Vehicles for households with more than four registered vehicles:

1. Fifth vehicle. 155.00

2. Sixth vehicle. 205.00

3. Seventh vehicle. 255.00

4. Eighth vehicle. 305.00

5. Ninth vehicle. 355.00

6. Tenth vehicle. 405.00

7. Tenth or more Increasing in increments of $50.00 per vehicle.

c. Vehicles with antique or historical plates issued by the Illinois Secretary of State shall not be

included when determining the total number of vehicles registered to a single household.

(2) Passenger automobiles and Class B vehicles only, not more than one vehicle registered to a person 62 years of age or older, upon showing proof of age and identification. No fee

a. For second and subsequent vehicles registered to a person 62 years of age or older, upon showing

proof of age and identification, each. 15.00

(3) Motorcycles, motor-tricycles or mopeds. 50.00

(4) Vehicles owned by units of local government. No fee

(5) Reserved.

(6) Vehicles registered with the Illinois Secretary of State with disabled/handicapped plates, as defined by the Illinois Secretary of State and the Illinois Vehicle Code

a. Not more than one vehicle registered, upon showing proof of identification and valid and permanent disability handicap placard. No fee

b. Second and subsequent vehicles registered, upon showing proof of identification and valid and permanent disability/handicap placard, each. 15.00

(7) Passenger and Class B vehicles only.

a. Not more than one vehicle registered to an honorably discharged veteran of the armed forces of the United States or vehicles registered with the Illinois Secretary of State with prisoner of war, purple heart plates. Congressional Medal of Honor plates and other appropriate military plates, as defined by the Illinois Secretary of State and the Illinois. Vehicle Code, upon showing proof of identification and honorable discharge. No fee

b. For second and subsequent vehicles registered as described in subsection 7(a) of this Section, upon showing proof of identification and honorable discharge, each. 15.00

(8) All other vehicles including trucks, tractor-semi-trailer units, motor buses, recreational vehicles, and trailers, by state classification or weight:

a. Class B, vehicles weighing 8,000 pounds or more with vanity, personalized or other specialty license plates not governed by any other subsection hereof, and recreation vehicles (RV). 90.00

b. Class D through F. 115.00

c. Class H through L. 165.00

d. Class N through 2. 90.00

The license fee applicable to a vehicle with vanity, personalized or other specialty license plate not governed by any other subsection hereof shall be determined by the weight of the vehicle as set forth on the vehicle registration issued by the Illinois Secretary of State.

(9) Vehicles with antique or historical plates issued by the Illinois Secretary of State. 20.00 per vehicle.

(10) Special demonstration plates issued by the Illinois Secretary of State sold to licensed automobile dealers or for authorized individuals driving a vehicle with such demonstration plates issued by a dealer located outside of the Town. 50.00 per license plate.

Notwithstanding anything in this Article to the contrary, the Town Collector shall issue regulations concerning the display of the license issued hereunder for special demonstration plates issued to motor vehicle sales rooms operating within the Town and to authorized individuals driving a vehicle with such demonstration plates issued by a dealer located outside of the Town. The license fees for special demonstration plates set forth hereunder shall not diminish a motor vehicle sales room operator's obligation to secure a business license as set forth in Section 106-197 of this Code.

(11) Taxicabs. 50.00 per vehicle.

Notwithstanding anything in this Article to the contrary, the Town Collector shall issue regulations concerning the display of the licenses issued here under for taxicabs. The license fee set forth here under shall not diminish a taxicab operator's obligation to secure a business license as set forth in Section 106-591 of this Code.

(b) All such licenses shall expire on June 30 following the date of issuance. Licenses purchased after March 1 shall be discounted to one-half the required license fees, provided that no late fees are otherwise applicable. Except as otherwise set forth herein, no license shall be issued for a period less than the full license year or for a fee less than a full annual license.

(c) This section and each of its terms shall be the effective legislative act of a home rule municipality without regard to whether such section should (i) contain terms contrary to the provisions of current or subsequent nonpreemptive state law or (ii) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the town that, to the extent the terms of this section shall be inconsistent with any nonpreemptive state law, this section shall supersede state law in that regard within the jurisdiction of the town.

On motion of Trustee Garcia seconded by Trustee Porod, the Ordinance authorizing and approving the purchase of equipment (100) Tasers from Alcon Enterprises Inc. for the Cicero Police Department at a total cost of $122,400,00), was accepted, placed on file and approved for passage by the following vote:

(Allows for the issuance of a business license to the applicant contingent upon the compliance to all federal, state, county and local laws without limitation to Town Codes), was accepted, placed on file and approved for adoption by the following vote:

On motion of Trustee Virruso seconded by Trustee Banks, the Resolution for Improvement by Municipality Under the Illinois Highway Code appropriating $18,000.00 out of MFT Funds for the Town's portion of the Laramie Avenue Bridge NBIS Inspection, was accepted, placed on file and approved for adoption by the following vote:

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

Nays: None.

On motion of Trustee Porod seconded by Trustee Raleigh, the Resolution authorizing the Town President to enter into a Preliminary Engineering Services Agreement with Frank Novotny and Associates Inc. regarding the Laramie Avenue Bridge NBIS Inspection required by IDOT (17-00230-00-BI), was accepted, placed on file and approved for adoption by the following vote:

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

On motion of Trustee Garcia seconded by Trustee Raleigh, the Resolution authorizing and approving the settlement of litigation and the execution of a settlement agreement in the case of T. Raia v Town of Cicero, (Case No. 2010 WC 012175), was accepted, placed on file and approved for adoption by the following vote:

Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso.

Nays: None.

President Dominick opened the meeting to the public for their comments. 

Resident Edward Robles recommended holding Board meetings in the evenings to increase public participation. 

Resident Matt Diaz expressed his dismay in the Board's action to opt-out of the Cook County Minimum Wage & Pay Sick Leave.

Corey Steel Representative Kathleen Sullivan requested the Board to take action to opt-out of the Cook County Minimum Wage & Pay Sick Leave.

Master Bob Schirmer of Combat-Do thanked the Board for their continued support and introduced Jose "Shorty” Torres

Rev. CJ Hawkins of United Methodist Church and ARISE. Chicago highlighted the benefits of the Cook County Minimum Wage & Pay Sick Leave and requested more clarification on Agenda item 9A, where the Board did opt-out of the Cook County Minimum Wage but has up to July 19 to give a decision on the Pay Sick Leave.

Zak Zakowski of Local 881 United Food and Commercial Workers International

Union (UFCW) addressed the Board concerning the Cook County Minimum Wage & Pay Sick Leave.

Superintendent Rudy Hernandez of School Board District 99 thanked the Board for their continued support of President Dominick's Literacy Program.

On motion of Trustee Virruso seconded by Trustee Porod, the board adjourned at 10:43 A.M. to meet in Executive Session.

On motion of Trustee Virruso seconded by Trustee Banks, the board reconvened at 11:51 A.M. to Open Session.

On motion of Trustee Raleigh seconded by Trustee Garcia, the minutes of the Executive Session held Tuesday, May 9, 2017, were accepted and approved.

Executive Session Agenda Items #13-A, #13-B, #13-C, #13-D, and #13-E were for informational purposes only - No action taken.

On motion of Trustee Reitz seconded by Trustee Wirruso, the town attorney was authorized to retain outside counsel, Attorney William G. Schur to file a collection action against Juan Ochoa and also file a citation to discover assets as discussed in Executive Session relative to Agenda Item #13-F; action taken by the following vote: Ayes: Banks, Cundari, Garcia, Porod, Raleigh, Reitz, Virruso. Nays: None.

No discussion was held regarding Executive Session Agenda Item #13-G.

On motion of Trustee Virruso seconded by Trustee Porod, the board then stood adjourned at 11:52 A.M. to meet om Tuesday, June 27, 2017 at 10:00 A.M., in the Town Hall, Town of Cicero.
